Welcome to Aastiv Tech. These Terms and Conditions govern your access to and use of our website, www.aastivtech.com, and explain the general terms applicable to our services.
By accessing or using our website, you agree to these Terms and Conditions. If you do not agree, please discontinue using the website.
1. About Aastiv Tech
Aastiv Tech provides website design and development, branding, logo design, graphic design, search engine optimisation (SEO), social media creatives, and related digital services.
Our services are provided according to the scope, pricing, and conditions agreed upon with each client.
2. Use of Our Website
You agree to use our website lawfully and not to:
- Use the website for fraudulent, unlawful, or harmful purposes.
- Attempt to gain unauthorised access to our website, systems, or data.
- Interfere with the website's operation, security, or functionality.
- Copy, reproduce, distribute, or commercially exploit our protected content without permission.
- Use our website in a way that infringes the rights of others.
We may take reasonable measures to protect our website and respond to misuse, subject to applicable law.
3. Our Services and Quotations
Information about our services on this website is provided for general informational purposes.
Project requirements, deliverables, prices, timelines, revisions, and payment arrangements will be discussed with the client and confirmed through a quotation or other written agreement.
A quotation may specify additional terms applicable to a particular project. Where project-specific terms differ from these general terms, the agreed project-specific terms will govern that matter.
Additional work outside the agreed scope may incur additional charges, which will be communicated to the client before the additional work is undertaken.
4. Payments
Unless otherwise agreed in writing, our standard payment arrangement is:
- An advance payment before work begins.
- The remaining balance when the website is completed and goes live.
Payments are made directly to the bank account designated by Aastiv Tech.
The applicable quotation will specify the agreed project price and payment requirements.
We may pause delivery or further work where an amount due remains unpaid, subject to the applicable agreement and law.
5. Website Code and Intellectual Property
Aastiv Tech retains ownership of its underlying website code, reusable components, frameworks, development methods, tools, and other pre-existing or reusable technical materials, except where third-party rights or a separate written agreement provide otherwise.
Unless expressly agreed otherwise in writing:
- Clients do not automatically acquire ownership of the underlying source code merely by purchasing a website.
- Clients receive permission to use the completed website for their agreed business purposes while complying with the applicable service agreement.
- Clients may not copy, resell, redistribute, or reuse our proprietary code or components to create or reproduce other websites without our written permission.
- Any transfer or licensing of source code beyond the agreed arrangement must be separately discussed and agreed upon in writing, including any applicable charges.
Third-party software, themes, libraries, fonts, plugins, and other licensed materials remain subject to their respective licence terms.
Client-provided content, trademarks, images, and other materials remain subject to the rights of their respective owners.
6. Domain Names and Hosting
Where a domain name is purchased or registered in the client's name, the client retains the applicable ownership and control rights associated with that registration.
If Aastiv Tech provides domain registration or hosting at no additional charge for an initial period, the duration and scope of that arrangement will be specified in the relevant quotation or agreement.
After the included period expires:
- Applicable domain and hosting renewal charges become the client's responsibility.
- Continued hosting and support are subject to the agreed renewal and service arrangements.
- The client is responsible for providing accurate registration information and completing required renewals.
If hosting or related services are discontinued, the availability of the website may be affected. Any transition, migration, or transfer assistance will be handled according to the applicable agreement and may involve additional charges.
Domain registration is subject to the applicable registrar's terms and policies.
7. Website Changes and Revisions
Unless otherwise agreed in writing, clients may request changes within the first six months following website delivery or launch, subject to the scope and limitations agreed for the project.
After this period, Aastiv Tech may continue to provide routine maintenance and technical support under the applicable support arrangement. However, substantial changes may be charged separately.
Examples of work that may require additional charges include:
- Major redesigns or layout changes.
- New pages or substantial new sections.
- New functionality or integrations.
- Significant changes to the original project scope.
- Extensive content replacement or restructuring.
We will communicate applicable additional charges before undertaking chargeable work.
8. Lifetime Website Support
Where a service package includes lifetime website support, this means support for the duration of the client's continuing service relationship with Aastiv Tech, subject to the applicable payment and renewal arrangements.
It does not mean that all future development, redesigns, new features, third-party subscriptions, domain renewals, hosting renewals, or external service charges are provided free of charge indefinitely.
The precise scope of support will be determined by the relevant quotation or written agreement.
9. SEO and Business Results
Aastiv Tech may provide SEO, website optimisation, and related digital services.
Search rankings, website traffic, enquiries, sales, and other commercial outcomes depend on many factors outside our control.
We do not guarantee specific search engine rankings, traffic levels, lead volumes, sales figures, or business results unless a specific guarantee is expressly agreed upon in writing.
Third-party search engines and digital platforms may change their algorithms, requirements, or services at any time.
10. Client Responsibilities
Clients are responsible for:
- Providing accurate information and materials.
- Ensuring that they have the necessary rights to materials they supply.
- Reviewing and approving project deliverables.
- Providing required feedback, content, and approvals within agreed timelines.
- Making payments when due.
- Ensuring that their business activities and supplied content comply with applicable laws.
Delays caused by missing information, approvals, or payments may affect project timelines.
11. Third-Party Services
Our website and services may rely on third-party providers, including hosting companies, domain registrars, communication tools, plugins, analytics services, and other external platforms.
We do not control all aspects of these services and cannot guarantee their uninterrupted availability or continued operation.
Third-party services may be subject to separate terms, licence conditions, charges, and privacy policies.
12. Website Content and Availability
We aim to keep our website accurate and available. However, we do not guarantee that all website content will always be complete, current, uninterrupted, or free from errors.
We may modify, suspend, or discontinue website features when reasonably necessary.
Nothing in these Terms excludes any rights or remedies that cannot legally be excluded.
13. Limitation of Liability
To the extent permitted by applicable law, Aastiv Tech will not be responsible for indirect or consequential losses arising from the use of our website or services where such exclusion is legally permitted.
Any liability arising from a specific client project will be subject to the applicable written agreement and applicable law.
Nothing in these Terms limits liability where such limitation is prohibited by law or excludes mandatory consumer rights.
14. Suspension and Termination of Services
Where a client breaches an applicable agreement, fails to make required payments, or uses our services unlawfully, we may take appropriate action under the relevant agreement and applicable law.
Such action may include suspending affected services or terminating the service relationship where legally and contractually permitted.
Outstanding payment obligations and other rights that have already arisen will remain subject to the applicable agreement and law.
15. Privacy
Our collection and use of personal information are explained in our Privacy Policy.
By using our website, you acknowledge that you can review that policy to understand how we handle personal information. Any consent required by applicable law will be obtained separately where necessary.
16. Changes to These Terms
We may update these Terms and Conditions from time to time.
The revised version will be published on this page with an updated date. Changes will apply as permitted by applicable law and will not automatically alter existing project agreements where separate terms govern the relevant matter.
17. Governing Law and Disputes
These Terms and Conditions are governed by the laws of India, subject to applicable legal requirements.
Disputes will be addressed through good-faith discussions where appropriate. Nothing in this section prevents a party from exercising any legal rights or remedies available under applicable law.
